A literary exhibition "The Constitution is the basis of peace and stability" in the East Kazakhstan Regional Library named after A.S. Pushkin.
What path preceded the adoption of the basic Law of Kazakhstan, which statesmen played an important role in the formation of the legislation of our country throughout history, interesting facts from the history of the constitutional construction of our state - the presented books testify to this.
The constitutional history of Kazakhstan began long before the emergence of the modern state. Since ancient times, the steppe rulers have tried to bring order to the life of the people and judge fairly with the help of a set of laws. At the beginning of the 16th century, during the reign of Khan Kasym, “Kasym khannyk Kasna Zholy” (“The bright path of Khan Kasym”) was developed. Khan Yesim adopted a number of amendments to this code, called “Yesim khannyk eski zholy” (“The ancient path of Yesim khan”). But the greatest success in this area was achieved by Khan Tauke, who became a co-author of the new set of steppe laws “Zheti zhangy” (“Seven codes”). About these first steppe laws - in the works of professor Salyk Zimanov - ten-volume "Ancient world of Kazakh law", monograph "Kazakh court of biys - general cultural value", etc.
The fundamental principles of the modern Constitution were laid down in 1911 by Barlybek Syrttanov in the Charter of "Kazakh Eli". As you know, on behalf of Alikhan Bukeikhanov, a draft Constitution of the country of Kazakhs was created. The charter, written in 1911, was much ahead of its time, its content was aimed at building an independent and legal state. Certain provisions of the Charter were included in the draft program of the Alash party in 1917. About outstanding figures of the Alash party, about Barlybek Syrtanov - a lawyer, scientist-doctor, orientalist, linguist - in the books of researchers S. Ozbekuly, N. Dulatbekov, E. Toktarbay, K. Raev.
The period from 1917 to 1995 covers the collection "Kazakhstan: stages of statehood" compiled by Zholymbet Baishev. It includes all the official texts of the basic laws of our state, from the program of the Alash party to the 1995 Constitution of the Republic of Kazakhstan with all further changes in them. Comparative analysis of the constitutional reforms of the twentieth century in Kazakhstan and Central Asian countries is carried out by the author M. Mataeva in his study "The constitutional history of Kazakhstan and Central Asian countries in the twentieth century." The monograph of the author M. Kemali is devoted to the issue of human rights and the mechanism of their protection on the basis of the laws of the Republic of Kazakhstan and international documents.
The founder of the scientific school of constitutionalists is rightfully considered Gairat Sapargaliev - a well-known Kazakhstani lawyer, academician of the National Academy of Sciences of the Republic of Kazakhstan, our fellow countryman, a native of Semey. Gairat Sapargaliev is a state scientist, one of the authors of many of the main laws of the country - the Constitution of the Kazakh SSR of 1978, the first Constitution of sovereign Kazakhstan in 1993, the current Constitution of 1995 and many other legal acts. The outstanding scientist has revealed whole layers of unknown pages of the history of state and law, the author of more than 60 monographs and textbooks, including "History of State and Law of Soviet Kazakhstan", "Fundamentals of State and Law of the Republic of Kazakhstan" "Establishment of the Constitutional System in Kazakhstan", "Constitutional Law Of the Republic of Kazakhstan, "Constitutional responsibility", "Parliamentary law", etc. At the exhibition of great interest is the author's monograph of 1948 "The emergence of the Kazakh Soviet statehood: 1917 - 1920." publishing house of the Academy of Sciences of the Kazakh SSR. The adoption of the current Constitution of the country was one of the most important and brightest moments in the history of the formation of a young independent state. The first President N.A. Nazarbayev personally supervised the preparation of this fundamental document. In the books "Kazakhstani Way", "The Era of Independence" the Leader of the Nation recalls that while preparing the current Constitution he studied the basic laws of different countries. Also at the exhibition are the works of the incumbent President Kassym-Jomart Tokayev: "Light and Shadow", "Overcoming", "He makes history."
The Constitution of Kazakhstan has embodied the rich centuries-old experience and wisdom of the Kazakh people in combination with the advanced achievements of world legal thought and serves as a reliable guarantee of the successful development of our state.
